Nearly everyone agrees that Judge Hudson's finding that the ObamaCare health insurance mandate is unconstitutional will be appealed to the Supreme Court.

Here's the kicker;

Justice Elena Kagan, having served in the Obama Justice Department, is surely to recuse herself. With the "liberals" one judge down, even a Kennedy vote to uphold the individual mandate would presumably result in a 4-4 tie. And guess what? If there is a tie, the lower ruling stands...

What is the proper criterion to apply? Well, a simple analogy illustrates the point best. Let's say you needed to hire a football referee. If he said that he was a "pragmatic" referee, who viewed the rule book as "living" and thus would interpret the rules to suit the "times," would he be your man?

The Republicans have failed - once again.

The Senate confirmation hearings on Elena Kagan's nomination to the Supreme Court have been a farce. Republican senators refused to challenge thoroughly and aggressively Ms. Kagan's transnational, leftist agenda. Instead, they hardly laid a glove on her. This is inexcusable.

Ms. Kagan is one of the most radical nominees to sit on, potentially, the highest court in the land. She is a postmodern academic cultural Marxist. Like Justice Sonia Sotomayor (the "wise Latina"), Ms. Kagan thinks social engineering trumps constitutional self-government...

If the Republicans cannot stand up against such a blatantly unqualified nominee and irresponsible ideologue, it is time conservatives consider abandoning the GOP and creating a third party.

Ms. Kagan's nomination deserves to be filibustered. That Republicans won't means they are unwilling - or unable - to confront the liberal regime. Ms. Kagan is laughing all the way to the top.

The 'Elusive' Truth About Kagan

Last year, when Barack Obama nominated Sonia Sotomayor for the Supreme Court, CBS anchor Katie Couric said labeling her “won't be easy.” CBS reporter Wyatt Andrews found “no clear ideology” in her public record. This week, the Washington Post embarrassed themselves with a front-page story claiming “Obama has not chosen outspoken liberals in either of his first two opportunities to influence the makeup of the court.”

That ridiculous sentence collides with a June 8 report by liberal Los Angeles Times legal reporter David Savage.

“The early returns are in, and Justice Sonia Sotomayor is proving herself to be a reliable liberal vote on the Supreme Court. Cases this year on campaign speech, religion, juvenile crime, federal power and Miranda warnings resulted in an ideological split among the justices, and on every occasion, Sotomayor joined the liberal bloc.”

[I.e., duped and/or betrayed by the Republicans again, who evidently feel a life-time-appointment was worth fighting to prevent.]

WH Takes Media Blackouts to New Level, Bars Reporter from Kagan Brother's High School Class

The White House has gone to extraordinary lengths to prevent the press corps from having meaningful access to Supreme Court nominee Elena Kagan. Such measures are hardly unprecedented, though they stand in stark contrast to then-candidate Barack Obama's message of openness and press transparency.

But now the White House has outdone itself in media opacity.

According to watchdog group Judicial Watch, White Hosue Deputy Press Secretary Joshua Earnest intervened after hearing of Times reporter Sharon Otterman's intention to sit in on one class. "I'm definitely not comfortable with this at this point," Earnest told Kagan, according to documents it obtained from the school.

It apparently blocked a New York Times reporter from sitting in on Kagan's brother Irving's constitutional law class at Hunter College High School. Yes, that's right. The White House is now trying to determine who can or cannot sit in a school class for teenagers...

The Post website summarized: "Republicans have struggled to find a compelling line of attack to take against the Supreme Court nominee. But their efforts have largely failed."

When Republicans nominate a Supreme Court justice, it's the liberal media that aids their favorite activists in creating "compelling lines of attack." But when Democrats do it, the journalists not only skip over the attacks, they also praise the Democrats for their political skills.

Post reporters Anne Kornblut and Paul Kane lauded the "skilled operatives" of Team Obama...

A Media Research Center analysis of the ABC, CBS and NBC evening newscasts in the six weeks since Kagan was nominated shows the broadcast networks have failed to cover the “fight,” and have ignored most of the controversies that could lead to suspenseful hearings this week.

MRC analysts found that the broadcast network evening newscasts aired just eleven stories about Kagan since her May 10 nomination (six on CBS, three on ABC and two on NBC), plus another three brief items read by the anchor.

All but one of those stories appeared during the first week after Kagan’s selection; only the CBS Evening News, in a June 3 report, has bothered to cover any of the thousands of pages of Kagan documents released in recent weeks...

Kagan Unqualified To Be on Court

Aside from never being a judge, she has never even been a trial lawyer. She has never questioned a witness, argued a case to a jury or tried any case to any jury anywhere in the United States. Real-world experience makes a difference. Reading books about something and actually doing it are two completely different things.

People's lives and livelihoods are at stake in these courtroom decisions, particularly when they reach our highest court. Courtroom experience is fundamental to being a judge on the Supreme Court. As anyone who has been through the court system can testify, a courtroom is a whole different world.

Putting Elena Kagan on the United States Supreme Court is like putting someone in charge of a brain surgery unit who has never done an operation. She may be qualified for the classroom, but she is certainly not qualified for the courtroom. She should stay in the schoolhouse since she has never been in trial at the courthouse.

The Supreme Court is no place for on-the-job training...

Military Families Caution Senators on Kagan Nomination

As Supreme Court-nominee Elena Kagan undergoes her first day of hearings before the Senate Judiciary Committee on Monday a military families group is raising concerns about her fitness to serve on the high court.

The group, Military Families United, sent a letter on Friday to Judiciary Committee Chairman Patrick Leahy (D-Vt.) and ranking member Sen. Jeff Sessions (R-Ala.) citing Kagan’s actions to block military recruiters from Harvard Law School – when she was the dean there (2003-09)

“We find Ms. Kagan’s failure to offer support to our military in a time of war, and her willingness to defy federal law as troubling and appalling,”

said the letter signed by Robert Jackson, director of government relations for Military Families United.

Military Families United, a non-partisan non-profit group, is not opposing the Kagan nomination outright.

POLL: Plurality Oppose Kagan's Confirmation To Supreme Court

The latest Rasmussen Reports national telephone survey of Likely Voters shows 33% think Kagan should be confirmed as a Supreme Court justice. But 41% do not think she should be confirmed, up eight points since President Obama announced her nomination in early May. Another 26% remain undecided.
