The Republicans have failed - once again.

The Senate confirmation hearings on Elena Kagan's nomination to the Supreme Court have been a farce. Republican senators refused to challenge thoroughly and aggressively Ms. Kagan's transnational, leftist agenda. Instead, they hardly laid a glove on her. This is inexcusable.

Ms. Kagan is one of the most radical nominees to sit on, potentially, the highest court in the land. She is a postmodern academic cultural Marxist. Like Justice Sonia Sotomayor (the "wise Latina"), Ms. Kagan thinks social engineering trumps constitutional self-government...

If the Republicans cannot stand up against such a blatantly unqualified nominee and irresponsible ideologue, it is time conservatives consider abandoning the GOP and creating a third party.

Ms. Kagan's nomination deserves to be filibustered. That Republicans won't means they are unwilling - or unable - to confront the liberal regime. Ms. Kagan is laughing all the way to the top.

What Bias? Re: WaPo Devotes 60-Paragraph Front Page Story to Workaholic Kagan, Pays Little Attention to Her Philosophy

Borrowing a line from one of her Harvard colleagues, the Washington Post entitled its June 10 front-page profile of Supreme Court nominee Elena Kagan, "Her work is her life is her work."*

But the 60-paragraph story by staff writers Ann Gerhart and Philip Rucker shed barely any light on the judicial philosophy that Kagan's life work demonstrates. Instead, Gerhart and Rucker presented a gauzy profile that rehashed the usual trivia -- Kagan loves poker and the opera -- while painting Kagan as a workaholic who still has time to lend an ear or a shoulder to cry on to friends in distress:

She has arrived at the age of 50 in a blaze of accomplishment. But her achievements can obscure how relatively narrow her world has been...

Military Families Caution Senators on Kagan Nomination

As Supreme Court-nominee Elena Kagan undergoes her first day of hearings before the Senate Judiciary Committee on Monday a military families group is raising concerns about her fitness to serve on the high court.

The group, Military Families United, sent a letter on Friday to Judiciary Committee Chairman Patrick Leahy (D-Vt.) and ranking member Sen. Jeff Sessions (R-Ala.) citing Kagan’s actions to block military recruiters from Harvard Law School – when she was the dean there (2003-09)

“We find Ms. Kagan’s failure to offer support to our military in a time of war, and her willingness to defy federal law as troubling and appalling,”

said the letter signed by Robert Jackson, director of government relations for Military Families United.

Military Families United, a non-partisan non-profit group, is not opposing the Kagan nomination outright.

Professor chooses professor

Obama graduated from Harvard Law School in 1991; Kagan in 1986. Kagan joined the faculty at the University of Chicago Law School in 1991 and became a full professor there in 1995. Obama taught constitutional law there from 1992 to 2004.

They have other things in common. Unusually for top law students who go on to teach law, they have published little: Kagan has written just five law review articles; Obama none. Nor, from all the accounts, has either of them expressed, even in conversation, opinions on many burning legal issues.

Reporters have unearthed some of their writings in college that sound sophomorically left-wing -- but, hey, they were sophomores then, and you won't find many such utterances later in their careers. Obama's autobiographies carefully avoid statements that might have proved politically toxic later.

This stealth strategy has certainly paid off: Obama is president, and Kagan is solicitor general and looks like a cinch to be confirmed for the Supreme Court.

But behind their careful avoidance of incendiary issue positions one can find evidence that both the appointer and the appointee share the standpoint of the professor. They bring to public service attitudes that are commonplace in the faculty lounge but not nearly so common in the rest of America...

That's up nine points from the week President Obama announced her nomination and the highest level of opposition to date in Rasmussen Reports tracking of the Kagan nomination.

The latest Rasmussen Reports national telephone survey of Likely Voters shows that 35% think Kagan should be confirmed by the U.S. Senate to the Supreme Court. Another 23% are undecided at this point...

WH Takes Media Blackouts to New Level, Bars Reporter from Kagan Brother's High School Class

The White House has gone to extraordinary lengths to prevent the press corps from having meaningful access to Supreme Court nominee Elena Kagan. Such measures are hardly unprecedented, though they stand in stark contrast to then-candidate Barack Obama's message of openness and press transparency.

But now the White House has outdone itself in media opacity.

According to watchdog group Judicial Watch, White Hosue Deputy Press Secretary Joshua Earnest intervened after hearing of Times reporter Sharon Otterman's intention to sit in on one class. "I'm definitely not comfortable with this at this point," Earnest told Kagan, according to documents it obtained from the school.

It apparently blocked a New York Times reporter from sitting in on Kagan's brother Irving's constitutional law class at Hunter College High School. Yes, that's right. The White House is now trying to determine who can or cannot sit in a school class for teenagers...

Supreme Court nominee Elena Kagan wrote in a 1996 article entitled "Private Speech, Public Purpose: The Role of Governmental Motive in First Amendment Doctrine" that "redistribution of speech" is not "itself an illegitimate end" for government.
As first reported by Matt Cover at the Media Research Center's news wing CNSNews.com, Kagan offers up this gem:

"If there is an ‘overabundance' of an idea in the absence of direct governmental action -- which there well might be when compared with some ideal state of public debate -- then action disfavoring that idea might ‘un-skew,' rather than skew, public discourse."

So if talk radio suffers from an "overabundance" of conservative voices, government action to "un-skew" this particular public discourse is just fine by her.

A Media Research Center analysis of the ABC, CBS and NBC evening newscasts in the six weeks since Kagan was nominated shows the broadcast networks have failed to cover the “fight,” and have ignored most of the controversies that could lead to suspenseful hearings this week.

MRC analysts found that the broadcast network evening newscasts aired just eleven stories about Kagan since her May 10 nomination (six on CBS, three on ABC and two on NBC), plus another three brief items read by the anchor.

Last year, when Barack Obama nominated Sonia Sotomayor for the Supreme Court, CBS anchor Katie Couric said labeling her “won't be easy.” CBS reporter Wyatt Andrews found “no clear ideology” in her public record. This week, the Washington Post embarrassed themselves with a front-page story claiming “Obama has not chosen outspoken liberals in either of his first two opportunities to influence the makeup of the court.”

That ridiculous sentence collides with a June 8 report by liberal Los Angeles Times legal reporter David Savage.

“The early returns are in, and Justice Sonia Sotomayor is proving herself to be a reliable liberal vote on the Supreme Court. Cases this year on campaign speech, religion, juvenile crime, federal power and Miranda warnings resulted in an ideological split among the justices, and on every occasion, Sotomayor joined the liberal bloc.”

NPR reporter Nina Totenberg found Judge John Roberts carried conservatism to wretched excess. On NPR's All Things Considered back in 2005, she prefaced “conservative” with three verys, describing him as “a very, very, very conservative man.”

But Totenberg matched other media liberals in finding no measurable ideology in Elena Kagan when her nomination was announced.

Why Ultra-Liberal Obama Needs Kagan On the Court

President Obama needs a Supreme Court that will rule that the Constitution allows the federal government to impose Obamacare’s individual mandate, ordering Americans how they must spend their own money. He needs a Supreme Court that will allow him to impose job-killing cap-and-trade and card-check rules through executive action, instead of legislation.
