Black Panther case expands

Even if the liberal media continue to ignore it, the Justice Department's dismissal of a voter-intimidation case against members of the New Black Panther Party is a full-blown scandal. Fortunately, the U.S. Commission on Civil Rights is pursuing justice even though the Department of Justice is not.

As reported in our news pages last Friday, the commission has sent a strongly worded letter to Attorney General Eric H. Holder Jr., effectively threatening to subpoena witnesses and documents if Justice does not provide better, more complete answers about its decision to dismiss the cases.

"We believe the Department's defense of its actions thus far undermines respect for rule of law," wrote the commission, "and raises other serious questions about the department's law enforcement decisions."

The case involves a nationally broadcast incident in which two Black Panthers in paramilitary garb, one of them wielding a nightstick, stood outside a Philadelphia polling place on Election Day in November. They were uttering racial epithets and otherwise discouraging voting.

Career attorneys at the Justice Department won a default judgment against both Black Panthers, plus a national Panther leader and the party as a whole -- but at the last minute, Obama appointees at Justice dismissed all the charges...

It has not answered the ''New'' Black Panther’s call daring it to report on voter intimidation by two paramilitary dressed Panthers, one of whom was brandishing a club, outside a Philadelphia polling place in 2008.

What is DOJ hiding in the New Black Panther case?

Republican Congressmen want to know the answer although Democrats seem perfectly content to have a bunch of thugs physically blocking access to polling places, using racial slurs and carrying nightsticks.

To try and find out why the Obama Justice Department dropped the case (or at least to get them on record saying it was for political purposes), a group of prominent GOP lawmakers have dispatched a letter to the DOJ Inspector General asking him to look into the matter.

But there really isn't much of a mystery why the case was dropped after the defendants offered no defense and the Department had a slam dunk win in its grasp; one of the local New Black Panther party defendants was carrying credentials at the time of his arrest indicating he was a member of the local Democratic party committee.

Justice is stonewalling on voter intimidation

Rarely does the U.S. Commission on Civil Rights vote unanimously on anything.

A partisan divide has made the commission contentious in recent years. Yet the [Holden] Department of Justice's decision to forfeit its voter-intimidation case against the New Black Panther Party and three individual defendants drew a 6-0 vote with one abstention by the commission. What unified the commission was outrage at the Justice Department for letting the Black Panthers off the hook.

The Civil Rights Commission has sent two letters -- on June 16 and June 22 -- to Loretta King, acting assistant attorney general for the civil rights division, asking for an explanation, but it has not received a response. Rep. Frank R. Wolf, Virginia Republican, sent a June 8 letter demanding an explanation, but the congressman told us he has yet to receive an answer from the department one month later... [snip]

The commission's letter quoted "Veteran of the civil rights movement, Bartle Bull" calling the defendants' actions

"the most blatant form of voter intimidation I have encountered in my life in political campaigns in many states, even going back to the work I did in Mississippi in the 1960s."

The commission summed up the case in its June 16 letter:

"Though it had basically won the case ... the [Department of Justice's Civil Rights] Division took the unusual move of voluntarily dismissing the charges .... In its notice of dismissal, the Division cites as its rationale only the fact that defendants failed to appear and respond ... the Division's public rationale would send the wrong message entirely - that attempts at voter suppression will be tolerated and will not be vigorously prosecuted so long as the groups or individuals who engage in them fail to respond to the charges leveled against them"

There's good reason for today's unanimity. The Justice Department needs to explain why it is not pursuing charges against these thugs.

The growing controversy is over a voter-intimidation case involving the radical New Black Panther Party and why Justice is carrying water for the villains. While I deplore the contemporary overuse and misuse of Nazi comparisons, there is no way that an historically knowledgeable, objective observer could fail to see the similarities between these thugs and the infamous Nazi Brown Shirts, whose very purpose for existing was this type of brute intimidation of the citizenry.

Drop the Investigation of CIA Interrogators

"We’re going to follow the evidence wherever it takes us, follow the law wherever that takes us.” So decreed Attorney General Eric Holder in April when asked whether government officials would face prosecution over coercive interrogation tactics used against terrorist detainees. After all, he elaborated, “no one is above the law.”

Tell that to the voters in Philadelphia who were threatened by nightstick-wielding Obama supporters from the New Black Panther Party. The Panthers got a pass even after they contemptuously ignored court process and even after the government already had prevailed in the case because of their default.

For the Obama/Holder Justice Department, other considerations outweighed following the evidence wherever it led. The Panthers who turned out to be above the law include Jerry Jackson, a credentialed Democratic-party poll-watcher who brays on MySpace about “Killing Crakkkas.” Thanks to Holder’s decision, Jackson is right back in business, having obtained new poll-watcher credentials just days after DOJ dismissed the case.

The CIA interrogators are having a rougher time with prosecutors than did the Black Panthers. They are retaining counsel and preparing for a lengthy investigation that likely will prove personally and professionally ruinous. The Los Angeles Times reported over the weekend that Holder is close to naming a prosecutor to probe whether the agency and its officers committed criminal misconduct.

The interrogators — whose use of harsh tactics resulted in the capture of leading jihadists, the disruption of mass-murder plots, and the saving of American lives — are in a different posture from that of Binyam Mohammed.

Mohammed was a leading jihadist who had been plotting some of those disrupted mass-murder attacks that were to take place in American cities. He was slated for prosecution by military commission. But it turned out that he was above the law, too...

Racism in health care bill seen by US Commission on Civil Rights

The US Commission on Civil Rights is proving a thorn in the side of the Obama administration. First it has problems with Attorney General Eric Holder's Justice Department dropping of the New Black Panther voter rights intimidation case. Now it sees the House health care bill having provisions that are racially discriminatory.

How? By making overt a preference to award billions of taxpayer dollars and preferential treatment to minority students for scholarships, and favoring medical schools that have a record of sending graduates to areas with inadequate health care services. Jennifer Haberkorn of the Washington Times has an exclusive story:

"These programs are unlikely to reduce health care disparities among racial and ethic groups," according to the draft letter obtained by The Washington Times. "A growing body of evidence indicates that increasing access to high-quality physicians - whatever their racial or ethnic ancestry - is the best way to mitigate such disparities."

The draft letter also cites testimony from Dr. Amitabh Chandra of Harvard University who said the idea that expanding the number of minority physicians and providing "cultural competence training" [?] will bridge the health status gap is "grounded in hope more than science," according to the draft language.

It cites research from Dr. Chandra that found that improving the quality of health care in the 500 largest minority serving areas would improve minority health care more than the elimination of racial disparities within every provider in the U.S.
